Sadly, three things combine to make motorcycle accidents more severe than other motor vehicle accidents:
1. The motorcyclist is in a particularly vulnerable position for there
is no passenger compartment protecting him or her;
2. The motorcyclist can be severely injured because of the crush
force inflicted by the other and heavier motor vehicle; and
3. The motorcyclist often does not have sufficient insurance
covering the motorcycle, particularly uninsured and
underinsured motorist insurance. (Uninsured motorist insurance
[UM] insures the motorcyclist if the person who caused the
collision does not have insurance. Underinsured motorist
insurance [UIM] insures the motorcyclist if the person who caused the collision does not have enough insurance to pay for all the damage that he or she caused. In many states, for example, in North Dakota and in Wisconsin, a motorist can only recover underinsured motorist insurance if the policy is HIGHER than the insurance policy for the at-fault driver).
When the motorcyclist or passenger suffers catastrophic injuries in the accident, there often is only a small insurance policy covering the motorcycle. If there is not adequate insurance coverage on the other vehicle involved, the motorcycle accident attorney needs to be creative in order to help the people injured.
